Terms of Service

These Terms govern your use of PitchButler. By creating an account or using the service, you agree to them. If you are using PitchButler for an organization, you confirm you are authorized to bind that organization.
1. The service
PitchButler is a one-to-one B2B sales-outreach tool. It sends individual emails from a mailbox you connect, matches and reads the replies, qualifies interest with AI, and hands promising conversations to you. It is not a bulk or list-mailing platform.
2. Eligibility & accounts
Access is currently invite- and waitlist-based. You are responsible for your account credentials and for all activity under your account. Provide accurate information and keep it current.
3. Acceptable use
You agree that you will not use PitchButler to:
- send spam, bulk unsolicited mail, or messages to purchased or scraped lists in violation of applicable law;
- send deceptive, misleading, fraudulent, harassing, or unlawful content, or falsify sender or routing information;
- contact anyone who has opted out or who you are otherwise not permitted to contact;
- violate any applicable anti-spam, privacy, or data-protection law (including CAN-SPAM, GDPR, and CASL); or
- violate Google's or any provider's terms, or attempt to evade sending limits, reputation controls, or the kill switch.
4. Your responsibilities as the sender
You are the sender of, and are responsible for, the messages you send and the contact data you upload. You confirm that:
- you have a lawful basis to contact each recipient (for EU/EEA/UK contacts, typically legitimate interest for relevant B2B outreach);
- your messages are truthful, identify you, and relate to your legitimate business;
- you will promptly honor opt-out and deletion requests - PitchButler's permanent do-not-contact list assists with this, but responsibility remains yours; and
- you have correctly configured email authentication (SPF, DKIM, DMARC) for your sending domain.
As between you and PitchButler, you are the data controller for your contact data and PitchButler is your processor; our Data Processing Agreement governs that relationship.
5. Connecting Google / Gmail
By connecting a mailbox you authorize PitchButler to send and read mail on your behalf to operate the features described in our Privacy Policy. You can disconnect at any time from Settings or revoke access in your Google Account; on disconnect we revoke our token and delete the Gmail-derived content we stored.
6. Sending limits & reputation controls
To protect deliverability and your domain, PitchButler enforces per-account daily limits, a warm-up ramp, human-like pacing, sending windows, and an automatic kill switch on high bounce or spam-complaint rates. We may pause sending to protect you or the platform.
7. Fees

8. Intellectual property
PitchButler and its software are owned by us and our licensors. You retain ownership of your content and contact data. You grant us the rights needed to operate the service for you.
9. Disclaimers
The service is provided "as is" without warranties of any kind. We do not guarantee deliverability, replies, or specific outcomes, and we are not responsible for the content of the messages you choose to send.
10. Limitation of liability
To the maximum extent permitted by law, PitchButler is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amounts you paid us in the 12 months before the claim. [REVIEW: confirm cap and carve-outs.]
11. Termination
You may stop using and close your account at any time. We may suspend or terminate access for breach of these Terms or to comply with law. On termination we delete or return your data as described in the Privacy Policy, subject to legal retention.
12. Governing law
These Terms are governed by the laws of Sweden, and disputes are subject to the courts of [REVIEW: venue], without regard to conflict-of-laws rules.
13. Changes
We may update these Terms; we will post the new "Last updated" date and, for material changes, notify account holders. Continued use after changes means you accept them.
